ACLU-PA Position: Support

HB 2105 (PN 2820) would amend the Pennsylvania Human Relations Act (PHRA) to update the act’s definitions of employer and employee. The PHRA protects Pennsylvanians from discrimination based on race, color, religion, ancestry, age, sex, national origin, familial status, and disability, including protection from discrimination in the workplace.

The PHRA currently excludes agricultural and domestic service workers from its protections. HB 2105 would remove these inherently discriminatory exemptions, as well as the exemption for workplaces with fewer than 4 employees, ensuring that all workers have a right to be protected from discrimination in the workplace.
