ACLU-PA Position: Opposes

SB 1021 (PN 1431) proposes two changes to current law. One section would add new evaluation/treatment provisions for gambling disorders. The ACLU-PA is neutral on those changes.

However, SB 1021 would also add a new suboffense under 18 Pa.C.S. § 4304 (endangering welfare of children) to make “leaving a child unattended in any part of a licensed gaming facility” a third-degree felony offense. This is an unnecessary and duplicative offense, since § 4304 would already penalize leaving a child unattended anywhere as a third-degree felony.
